1. Acceptance of Terms

By accessing or using Kinosis ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

Kinosis is operated by Kinosis ("we", "us", or "our"). We reserve the right to update these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

Kinosis is a WhatsApp-based health memory assistant that helps you track and organize personal health information, including but not limited to:

  • Symptoms and health conditions
  • Meals and nutrition
  • Physical activities and exercise
  • Moods and emotional states
  • Medications and supplements
  • Life events and milestones

3. Not Medical Advice

IMPORTANT: Kinosis is NOT a medical service and does NOT provide medical advice, diagnosis, or treatment. The Service is designed solely to help you organize and remember your health information.

You should always:

  • Consult qualified healthcare professionals for medical advice
  • Never disregard professional medical advice based on information from Kinosis
  • Seek immediate medical attention for emergencies
  • Not rely on Kinosis for critical health decisions

4. User Responsibilities

By using Kinosis, you agree to:

  • Provide accurate information
  • Use the Service only for lawful purposes
  • Not attempt to access other users' data
  • Not use the Service to transmit harmful content
  • Not interfere with the Service's operation
  • Maintain the security of your WhatsApp account

5. Accuracy of Information

Kinosis uses artificial intelligence to process and organize your health information. While we strive for accuracy, AI systems can make mistakes. You acknowledge that:

  • Information extracted from your messages may not always be accurate
  • Nutritional estimates from food photos are approximations
  • You should verify important information before relying on it
  • We are not responsible for errors in AI-generated content

6. AI Processing & Third-Party Providers

To power its AI features, Kinosis transmits your conversation messages to Anthropic, Inc. ("Anthropic"), an AI safety company. By using the Service, you acknowledge and agree that:

  • Your conversations may be processed by Anthropic's AI systems to generate responses
  • Data sent to Anthropic is used solely to provide the Service to you
  • Your data is not sold or used to train AI models
  • Anthropic's data handling is governed by their own Privacy Policy

We may in the future offer processing via locally-run AI models where your data does not leave your device or our servers.

7. Intellectual Property

The Service, including its design, features, and content (excluding user-provided content), is owned by Kinosis and protected by intellectual property laws. You may not copy, modify, or distribute our Service without permission.

8. User Content

You retain ownership of the health information and content you provide to Kinosis. By using the Service, you grant us a limited license to process, store, and display your content solely for providing the Service to you.

9. Termination

You may stop using Kinosis at any time. We reserve the right to suspend or terminate your access if you violate these Terms. Upon termination, you may request deletion of your data by contacting us.

10. Limitation of Liability

To the maximum extent permitted by law, Kinosis and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of data or information
  • Health outcomes or medical decisions
  • Service interruptions or errors
  • Unauthorized access to your data

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

13. Acknowledgement (Apple App Store)

If you downloaded the Kinosis app from Apple's App Store, you acknowledge that:

  • This End User License Agreement is between you and Kinosis only, and not with Apple, Inc. ("Apple"). Apple is not responsible for the Kinosis app or its content.
  • Kinosis, not Apple, is solely responsible for the app and its content.
  • This agreement does not conflict with the Apple Media Services Terms and Conditions.

14. Scope of License

Kinosis grants you a non-transferable license to use the Kinosis application on any Apple-branded products that you own or control, subject to the usage rules set forth in the Apple Media Services Terms and Conditions. This license does not allow you to use the app on any device that you do not own or control, and you may not distribute or make the app available over a network where it could be used by multiple devices at the same time.

15. Maintenance and Support

Kinosis is solely responsible for providing maintenance and support services with respect to the app, as specified in these Terms or as required by applicable law. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the Kinosis app.

16. Warranty

Kinosis is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed under these Terms. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the app, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Kinosis's sole responsibility.

17. Product Claims

Kinosis, not Apple, is responsible for addressing any claims you or any third party may have relating to the app or your possession and/or use of the app, including but not limited to: (i) product liability claims; (ii) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation. This agreement does not limit Kinosis's liability to you beyond what is permitted by applicable law.

18. Intellectual Property Rights

In the event of any third-party claim that the app or your possession and use of the app infringes that third party's intellectual property rights, Kinosis, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

19. Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

20. Third-Party Terms

You must comply with applicable third-party terms of service when using the Kinosis app. For example, if you use a VoIP application, you must not violate their wireless data service agreement when using the app.

21. Third-Party Beneficiary

Kinosis and you acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this End User License Agreement, and that, upon your acceptance of the terms and conditions of this agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this agreement against you as a third-party beneficiary thereof.
